File Lawsuits Against Similac

A premature baby always needs extra care and nutrition in order to keep them stable before they leave the hospital. These infants are kept in a Neonatal Intensive Care Unit, or NICU. They are sometimes given baby formulas that are cow’s milk supplements, such as Similac or Enfamil. However, recent evidence shows that such supplements can cause infants to develop necrotizing enterocolitis, a potentially deadly digestive condition.

Unfortunately, for new parents with premature babies, it is not unfair to worry about the impacts of an unsafe baby milk formula product. If your child has developed health concerns as a result of their baby milk formula, People for Law is there for you. We have 20 years of experience in dealing with mass tort cases against NEC formula lawsuits.

What are the Claimants Alleging in NEC Lawsuits?

Recent studies warn about the potential dangers of giving formulas made of cow’s milk to prematurely born infants. These risks include numerous intestinal and dietary conditions, such as NEC, which could be fatal. As a result, many parents are filing NEC formula lawsuits alleging that the manufacturers promoting milk formula made of Similac and Enfamil have not made adequate adjustments to either the formula itself or its labeling and packaging. Moreover, the instructions and warning labels are vague and nondescript. To make matters worse, there is no mention of potential risks of NEC in infants mentioned in baby milk formula containing Similac and Enfamil.

Dangers of Necrotizing Enterocolitis (NEC)

Necrotizing enterocolitis, or NEC, is a severe disease that affects the intestines of premature infants. It typically happens within the first two weeks of life in babies who are fed formula instead of breast milk. Some symptoms of NEC in your infant are as follows:

  • Swollen or bloated belly
  • Green vomit with bile
  • Bloody poop
  • Trouble breathing, low heart rate, or sluggishness
  • Feeding intolerance or reluctance to eat
  • Temperature instability (fever or low body temperature)

Most infants survive the disease with severe and lifelong impact affecting their overall well-being. In some cases, this damage may ultimately cause a perforation or a hole in the organ of the infant, which leads to stool seeping into the abdominal cavity. After intensive treatment, NEC is still very serious and fatal.

Manufacturers Sued in NEC Lawsuits

As a potential claimant, you should note that the defendants in NEC baby formula lawsuits are not the doctors, nurses, or other healthcare professionals working in NICUs across the country. The companies that manufacture and distribute these products are the ones held responsible in a lawsuit.

In recent times, Abbott Laboratories, the producer of Similac, and Mead Johnson and Company, the manufacturer of Enfamil, are currently being sued by parents whose children developed health issues after ingesting baby milk formula products.

Who is at Risk for Developing NEC?

Although NEC can affect any newborn, it is most common in premature babies who weigh less than 3.25 lbs. They have not developed immune systems capable of fighting off harmful bacteria produced after consuming Similac and Enfamil-based milk formulas.

Do I Qualify for an NEC Baby Formula Lawsuit?

Those who are more susceptible to developing necrotizing enterocolitis after being fed Similac, Enfamil, or another cow milk-based baby formula include:

  • Premature babies born before the 37th week of pregnancy
  • Infants receive enteral nutrition via a feeding tube.
  • Infants weighing under 5.5 pounds at birth.
  • Children born at hospitals with limited access to breast milk

If your child was born premature, fed a cow’s milk-based formula, and developed necrotizing enterocolitis, you may be eligible to file for an NEC baby formula lawsuit.
